PRESS RELEASE - January 22, 2005 On Today, 24 January 2004, the court will hear an application for leave to appeal for a judicial review of An Bord Pleanala's decision to grant permission for a toxic waste incinerator at Ringaskiddy. The Ringaskiddy Residents and 11 individuals from Cork Harbour who are taking a case aiming to quash planning for the Ringaskiddy Incinerator, are very pleased that the case has finally been given a court date. An Bord Pleanala granted permission over a year ago (16 Jan, 2004). Permission was granted against the recommendation of An Bord Pleanala's senior planning inspector, who gave an unprecedented 14 reasons why permission should be refused. Cork County Council had earlier refused planning. A spokesperson for CHASE said, “We were becoming very concerned that senior cabinet members were granted speedy access to the courts for private matters, while this case, which affects whole communities in Cork Harbour, was unable to get a judge. We are now at the beginning of a new phase in the campaign. We have full confidence in the independence of the judicial process and trust that the court will give the application full attention and find that there are substantial grounds to decide to grant a judicial review.
