Where do we go from here?                                                Judicial Review
In light of overwhelming public anger and dismay at An Bord Pleanala's decision to grant planning permission for the hazardous waste incinerator at Ringaskiddy, an application for a judicial review was lodged with the High Court on March 9th.

The challenge is being brought against An Bord Pleanála, the State, and the Attorney General, by the Ringaskiddy and District Residents Association and 11 harbour residents. The applicants are seeking to overturn the planning permission on several grounds, including that it breaches our rights under the Constitution, under two EU Directives and under the European Convention on Human Rights.

After numerous deferrals and postponements, the application for a Judicial Review was heard on 24th January 2005. The judge found significant grounds for allowing a Judicial Review and the case now awaits a date for hearing by the High Court.

To safeguard our environment for ourselves and future generations, it is imperative that we support this action!

EPA Waste Licence
The EPA's decision to grant a waste licence for two incinerators at Ringaskiddy (Nov. 2005) has also been appealed to the courts. In January 2006, Ringaskiddy and District Residents' Association Ltd lodged an application with the High Court for a judicial review of the EPA’s decision. No date has yet been set for hearing.
